WELCOME TO JAQ & SAIBA

These Terms govern your use of this website and purchases from Jaq & Saiba LTD, trading as Jaq & Saiba / Kalamelu. By placing an order or using the website, you agree to these Terms, together with our Privacy, Shipping, Returns, and Payment policies. If there's a conflict, applicable law prevails. 1. ELIGIBILITY & AUTHORITY

You must be legally capable of entering the transaction, or act with the authorisation legally required for your age or circumstances. You're responsible for accurate information and for keeping any account or order link secure.

2. PRODUCT INFORMATION

We aim to describe colour, texture, dimensions, fit, and materials accurately. Screens, small-batch processes, and handmade work may create reasonable variation. A variation doesn't excuse a product that's faulty, materially misdescribed, or otherwise non-compliant with law.

3. ORDERS & ACCEPTANCE

Submitting an order is a request to buy. We may check availability, production capacity, delivery feasibility, and payment. A contract is formed when we successfully verify your payment. Until that point, we reserve the right to cancel or refuse any order at our discretion. We may decline before acceptance for a lawful reason and return any money received.

4. PRICES & PAYMENT

Prices are shown in Rwandan Francs and exclude applicable taxes. Delivery and customisation are shown separately where relevant. Only Mobile Money and bank transfer are accepted. Payment details, verification, and fraud safeguards follow our Payment Policy.

5. MADE-TO-ORDER & CUSTOM WORK

Production begins after full payment and written approval of measurements, design, and lead time. Customer-requested changes after approval may affect price and timing. The lawful treatment of deposits, cancellations, alterations, and defects will be stated in your order.

6. DELIVERY

Delivery estimates aren't guarantees unless expressly agreed. Our Shipping Policy explains local methods, tracking limits, recipient duties, delays, and failed handovers. Any transfer of title or risk remains subject to law.

7. RETURNS & REMEDIES

Our Returns Policy forms part of these Terms. Nothing in it limits a remedy or right that cannot lawfully be excluded.

8. INTELLECTUAL PROPERTY

The Jaq & Saiba name, mark, designs, patterns, photographs, text, graphics, and other brand materials are owned by or licensed to us. No licence is granted except ordinary personal use of the website. Written permission is required for commercial reproduction, adaptation, or brand use.

9. REVIEWS, PHOTOS & COMMUNITY CONTENT

If you submit content, you confirm you have the right to share it. We may use it only within the scope of the permission you give. Event photography, testimonials, and affiliate content require clear consent and a stated use.

10. ACCEPTABLE USE

Don't misuse the website, attempt unauthorised access, interfere with operation, submit unlawful or harmful content, impersonate another person, or use brand materials to mislead.

11. THIRD-PARTY SERVICES

Delivery, banking, Mobile Money, social, and other services are operated by third parties. Their own terms may apply. We remain responsible to the extent required by our contract and applicable law.

12. LIABILITY

We don't exclude liability that cannot lawfully be excluded. Subject to that rule, any limitation must be reasonable, proportionate, and reviewed by Rwandan counsel. No blanket waiver for defective goods, injury, fraud, gross negligence, or failure to perform legal duties.

13. EVENTS OUTSIDE REASONABLE CONTROL

Neither party is responsible for delay caused by an event it couldn't reasonably prevent, but we must communicate, mitigate the effect, and resume performance where possible. Payment already received and unresolved obligations remain subject to law.

14. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of Rwanda. Please contact us first so we can try to resolve concerns in good faith. This doesn't remove any right to contact a regulator, use an available complaint mechanism, or bring a claim before a competent court.

15. CHANGES & SEVERABILITY

We may update these Terms prospectively. Material changes will be dated and communicated where required. If one provision is unenforceable, the remaining provisions continue to the extent lawful.
